These Terms of Service constitute a legally binding agreement between you and BLUE SALES, LLC. By accessing or using our services, you agree to be bound by these terms.
These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Customer," "You," or "Your") and BLUE SALES, LLC, a limited liability company incorporated under the laws of the State of Wyoming and doing business in Virginia, United States of America ("BlueSales," "Company," "We," "Us," or "Our").
By accessing, registering for, or using the BlueSales platform, websites, mobile applications, services, APIs, integrations, or any affiliated products or offerings (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1.1 "Services" means the BlueSales telemarketing software-as-a-service platform, including but not limited to artificial intelligence–driven call automation, sales outreach, analytics, customer engagement tools, email follow-up functionality via SMTP, and any related products or support.
1.2 "User" or "Customer" means any individual, company, organization, or entity that registers for, accesses, or uses the Services.
1.3 "Content" means all data, text, audio, voice recordings, customer lists, contacts, phone numbers, email addresses, messages, and any other material submitted or transmitted through the Services.
1.4 "Suspended Regions" means geographic locations where the Services are prohibited or unavailable, currently including India and Pakistan, with BlueSales reserving the right to expand, modify, or amend this list at any time in its sole discretion.
2.1 You must be at least eighteen (18) years old and have the legal capacity to enter into binding contracts in order to use the Services.
2.2 By registering, you represent and warrant that you are not located in, under the control of, or a national or resident of any Suspended Region or any jurisdiction subject to comprehensive U.S. sanctions, embargoes, or export restrictions.
2.3 BlueSales may deny or revoke access to the Services in Suspended Regions or other jurisdictions without liability, notice, or obligation to refund any fees paid.
2.4 BlueSales may, at any time and in its sole discretion, expand the list of Suspended Regions, and your continued use of the Services after such expansion shall constitute your acceptance.
Currently Suspended Regions: India, Pakistan
Users from these regions are prohibited from accessing or using our services. This list may be updated at any time.
3.1 Subject to these Terms, BlueSales grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services strictly for lawful business purposes.
3.2 You acknowledge and agree that you are solely responsible for the manner in which you use the Services, including but not limited to telemarketing practices, data processing, data collection, and communications with third parties.
3.3 BlueSales does not guarantee any outcomes, sales performance, or success metrics. The Services are tools; results depend on your usage, compliance, and external factors.
3A.1 BlueSales offers optional sign-in via Google OAuth and Microsoft OAuth (Azure AD). By using these sign-in methods, you authorize BlueSales to receive basic profile information (name, email address) from the respective provider solely for the purpose of creating and authenticating your account. You may revoke this access at any time through your Google or Microsoft account settings.
3A.2 BlueSales offers an optional Google Calendar and Microsoft Outlook calendar integration. By connecting your calendar, you authorize BlueSales and its AI agents to:
3A.3 You represent that you have the authority to grant BlueSales access to any calendar you connect and that such access does not violate the rights of any third party.
3A.4 Calendar access is used solely to provide the appointment booking features of the Services. BlueSales does not use your calendar data for advertising, profiling, or any purpose unrelated to scheduling on your behalf. Our use of data obtained via Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.
3A.5 You may disconnect any calendar integration at any time from your account settings. Disconnecting will immediately revoke BlueSales' access. BlueSales is not liable for missed appointments or scheduling errors that result from disconnecting an integration.
4.1 You agree to comply fully with all applicable local, state, national, and international laws, regulations, and industry standards, including but not limited to:
4.2 You acknowledge that compliance obligations rest exclusively with you, the User, and not with BlueSales. You agree to indemnify, defend, and hold BlueSales harmless against any claims, fines, penalties, damages, or liabilities arising from your failure to comply.
4.3 You agree that BlueSales has no responsibility to monitor your compliance and shall not be liable for your actions, omissions, or communications.
You may not use the Services to engage in or promote any of the following:
Violation of this section may result in immediate account suspension or termination without notice or refund.
6.1 Billing Provider: Payments for Services are processed exclusively through Stripe or such other third-party payment processor as BlueSales may designate.
6.2 Subscriptions: Services are offered on a subscription basis, billed monthly or annually in advance.
6.3 No Refunds: All fees paid are final and non-refundable, regardless of early termination, suspension, lack of use, or dissatisfaction.
6.4 Taxes: You are responsible for paying all applicable taxes, duties, or levies associated with your use of the Services.
7.1 BlueSales reserves the right, at its sole discretion, to suspend or terminate your access to the Services for any reason or no reason, including but not limited to:
7.2 No refund or credit shall be issued upon suspension or termination.
7.3 BlueSales may preserve or disclose Content if required by law, legal process, or governmental request.
8.1 All rights, title, and interest in the Services, including software, code, algorithms, designs, branding, and documentation, are owned exclusively by BlueSales and its licensors.
8.2 You may not copy, modify, reverse-engineer, decompile, resell, or create derivative works from the Services.
9.1 The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
9.2 BlueSales expressly disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
10.1 To the maximum extent permitted by law, BlueSales, its officers, employees, contractors, and affiliates shall not be liable for:
10.2 You agree that these limitations form an essential basis of the bargain and shall apply even if remedies fail of their essential purpose.
You agree to indemnify, defend, and hold harmless BlueSales from and against any claims, liabilities, losses, damages, costs, and expenses (including attorneys' fees) arising from your:
12.1 These Terms shall be governed by and construed in accordance with United States federal law, without regard to conflict of law principles.
12.2 You agree that any disputes shall be subject exclusively to the jurisdiction of federal courts located in the United States.
13.1 BlueSales may update or modify these Terms at any time, with or without notice.
13.2 Continued use of the Services after modifications constitutes your acceptance.
